Learning objectives

 

Referring to knowledge

— Describe the legislation regulating occupational risk prevention.
— Identify applicable legislation and sources of law.
— Be familiar with the content of the Spanish Law on Occupational Risk Prevention (Ley de Prevención de Riesgos Laborales).

— Identify sources of information on risk prevention.
— Interpret the Labour Risks Prevention Act (Ley de Prevención de Riesgos Laborales, 31/1995) and be familiar with the various laws and regulations related to it.
— Apply laws and regulations in scenarios where labour relations have become a determining factor.
— Demonstrate problem-solving teamwork skills.

 

 

Teaching blocks

 

1. Teaching block 1. Introduction to occupational risk prevention and origins of legal instruments

*  In this teaching block students examine the legal aspects of occupational risk prevention, the origins of the laws specifically addressing risk prevention and the political and ideological movements that paved the way for the creation of laws during the twentieth century.

1.1. Definition of occupational health and safety

1.2. Origins of the Spanish legislation that protects safety, hygiene and health at work

2. Teaching block 2. Sources of law

*  In this teaching block students examine the legal basis of occupational risk prevention in both the national and international arenas, focusing on different sources and levels of law and learning how legal instruments are implemented.

2.1. The International Labour Organization (ILO): I The ILO’s remit in questions of safety and health; II Conventions and recommendations; III Ratification and application

2.2. The protection of occupational safety and health in European legislation: I Social policy in the framework of the European Union; II EU action programmes; III The actions of organisations dedicated to improving occupational health; IV EU directives; V The Charter of Fundamental Rights of the European Union

2.3. General Spanish legislation on occupational safety and health: I The Spanish Constitution of 1978: the definition of Spain as a social and democratic state subject to the rule of law, and the construction of the welfare state; II The Workers’ Statute (Estatuto de los Trabajadores); III Other laws and acts after the Constitution

2.4. Specific Spanish legislation on occupational safety and health: the Labour Risks Prevention Act (31/1995); I Preliminary aspects; II General principles and purpose of the Law; III Scope of application; IV Spanish occupational safety and health law since the enactment of the Labour Risks Prevention Act: suppression, validation and development;

2.5. I Spanish legislation on occupational safety and health and collective bargaining. II Questions of virtuality in negotiating safety, hygiene and health in the workplace; III Safety and hygiene in framework agreements.

3. Teaching block 3. Rights and duties of beneficiaries of occupational risk prevention programmes

*  In this teaching block students examine the profile of those who have rights and duties regarding occupational risk prevention, focusing on both the public and private sectors.

3.1. Prevention policy and the public administration system (how the public administration system manages risk prevention): I The state’s duty to implement policies providing occupational safety and health; II Occupational safety and health in the framework of Labour Risks Prevention Act (objectives and means of achieving these); III How the law acts (application of laws and regulations); IV How the administration acts (the different branches of the public administration system responsible for risk prevention); organic structure;

3.2. Employees’ rights: I General considerations; II Employers’ responsibilities (the general duty to provide risk prevention); III Risk assessment; IV Planning prevention programmes (work groups and preventive measures); V Information and training; VI Emergencies and situations of serious or imminent risk; VII Monitoring employee health; VIII Documenting employee health and employer notification; IX Coordinating business organisation activities

3.3. Employee participation (the right to information and to consultation and employee representation in risk prevention programmes): I Employee participation and the right to information and consultation; II Employee representation in risk prevention programmes; III Safety and health committees

3.4. Preventive measures for especially vulnerable groups (with a special reference to the gender perspective): I Employees who are especially vulnerable to specific risks; II Safe maternity; III Protection of minors; IV Temporary employees and temporary employment agencies; V Employees’ duties

 

3.5. Other parties with obligations associated with risk prevention (manufacturers, importers and suppliers): I Introduction; II General and specific duties of manufacturers, importers and suppliers; III Determining responsibility and its scope (examples)

4. Teaching block 4. How businesses provide an occupational risk prevention programme

*  In this teaching block students examine the different models for organising risk prevention programmes as these are set out under the Labour Risks Prevention Act according to the number of employees sharing a workplace and the degree of danger their professional activity exposes them to.

4.1. Principles and objectives, specialist aspects and introduction to programme models: I The employer’s contractual obligation to provide risk prevention as the basis for a company’s risk prevention service; II Current structure of a company’s risk prevention programme as set out in the legislation; III Introduction to programme models

4.2. General models: I Introduction; II Programmes where the employer is responsible for implementing the prevention measures; III Programmes where one or more than one employee is responsible for implementing the prevention measures

4.3. Specific models, common aspects of programmes and external audit: I Analysis of specific models; II How the public administration system provides specialist support in risk prevention; III External audit for companies managing their own risk prevention programme

5. Teaching block 5.

*  In this teaching block students review the obligations of the different parties responsible for ensuring occupational risk prevention and examine the penalties for non-compliance, focusing on concurrent responsibilities and on determining which parties can be sanctioned for non-compliance

5.1. Criminal and civil liability and liability in social security law: I. Introduction (concurrent responsibilities arising from the same non-compliance); II Criminal liability; III Civil liability; IV Corporate liability in social security law; V Other kinds of liability in safety and hygiene

5.2. Administrative liability I Introduction; II Background; III The Labour and Social Security Inspectorate (Inspección de Trabajo y la Seguridad Social) IV Administrative violations under the Labour Violations and Sanctions Act (Ley sobre Infracciones y Sanciones en el Orden Social). V Proceedings by which the administration sanctions violations; VI Sanctions and sanctioning authority;
